WILKES-BARRE, LUZERNE COUNTY (WBRE/WYOU) — Police are charging an 18-year-old after they say he shot at a delivery driver, causing a crash that injured a baby.

According to the Wilkes-Barre Police Department, 18-year-old Jonyel Henriquez Diaz was arrested for allegedly shooting at 20-year-old Rufino Jimenez De La Cruz in the 600 block of North Main Street on the night of February 10.

Police stated De La Cruz was working for Uber and was in the process of making a delivery when he and a passenger in his car got into an argument with two other men in a parking lot.

During the argument, Henriquez Diaz allegedly fired two gunshots as De La Cruz reversed, and while speeding away, De La Cruz struck a car which hit a man who was carrying his 1-year-old baby, investigators reported.

Police charged De La Cruz with fleeing the scene of an injury accident for failing to stop after injuring the father and the baby.

On March 21, when police went to arrest Henriquez Diaz, they said he fled on foot and threw a loaded pistol into some bushes. Officers chased Henriquez Diaz and used a stun gun to subdue him.

Henriquez Diaz was charged with aggravated assault, simple assault, reckless endangerment, shooting into an occupied vehicle, and carrying a concealed weapon without a license. His bail was set at $500,000.
