SCRANTON, LACKAWANNA COUNTY (WBRE/WYOU) — Lackawanna County has filed a lawsuit against the contractor hired to reconstruct the "leak-plagued" swimming pool at McDade Park.
The county's suit against D&M Construction Unlimited, of Dalton, alleges that the "contractor breached its contract with the county through 'defective' work."
D&M was hired for the $2,637,000 contract in February 2023 to work on a new bathhouse and renovate the pool, which was supposed to be completed by July 2023.
The county and the contractor later agreed to extend the completion deadline to August 2023. D&M started the repairs in April 2024, which delayed the pool opening, the suit states.

According to the lawsuit, when "D&M turned the pool over to Lackawanna County for use, the pool was leaking water" at the rate of 12 inches of lost water per day. The county says an analysis determined the issue was not resolved.
This year, continuing leaks stopped the pool from being used. The suit also claims that there are "ponding and drainage at the front of the new bathhouse that were caused by defective work," as stated in the release.
The county says they're in the process of issuing a request for proposals to repair the pool, and confirmed that the pool will remain closed for the remainder of this year.
