Lawyers file appeal in Lackawanna County to PA Supreme Court

LACKAWANNA COUNTY (WBRE/WYOU) — Lawyers for Lackawanna County are asking Pennsylvania's highest court to step into a fight over how to replace a former commissioner.

On Tuesday, attorneys for Commissioner Bill Gaughan and the county filed a petition asking the state supreme court to hear their case.

Superior Court asked to reconsider overturned DUI sentence

It stems from the vacancy left by former commissioner Matt McGloin, and whether the county's home rule charter or a state rule of civil procedure should decide who fills it.

A panel of local, senior judges and the Commonwealth Court have already ruled the charter should prevail.

McGloin resigned as commissioner back in March.
