(WBRE/WYOU) — A Luzerne County attorney whose conviction in a deadly DUI crash was overturned may now return to court.
The Carbon County District Attorney has petitioned the Superior Court to reconsider its ruling in the case of 73-year-old Joseph Persico.

The District Attorney wants the full court, rather than just a panel, to hear the case again.
Persico was serving up to 6 years in prison for a wrong-way crash that killed Paul Gerrity of Scranton in 2018.
His conviction was overturned last month when the Superior Court ruled that Persico's rights were violated and the blood drawing that determined he was under the influence was taken without probable cause.
